Terms of Service for DAPS Services

These Terms of Service govern your access to and use of the DAPS Services website, including dapspest.com, its customer portal, online forms, and related digital features collectively referred to as the “Site.” In these Terms, “DAPS Services,” “we,” “our,” and “us” refer to DAPS Services, LLC. Pest control and related services may also be governed by an estimate, proposal, invoice, warranty, customer authorization, or separate service agreement. If a service-specific document conflicts with these Site Terms, the service-specific document controls for that service.
Please review these Terms carefully before using the Site or requesting our services.
1. Acceptance of Terms
By visiting, accessing, or using the Site, you confirm that you have read and understood these Terms and agree to follow them.
When you use the Site on behalf of a company, property owner, association, or another organization, you represent that you have permission to act for that entity and accept these Terms on its behalf.
Do not use the Site if you disagree with any part of these Terms.
2. Services Provided
DAPS Services provides residential and commercial pest-control services and may offer other services described on the Site or in a written estimate, proposal, invoice, or service agreement.
Descriptions found on the Site are provided for general informational purposes. The exact scope, schedule, price, treatment method, guarantee, and customer responsibilities for a particular service may be stated in a separate written agreement.
We may revise, add, remove, pause, or discontinue Site features or service offerings when necessary. Changes to the Site do not alter an existing signed service agreement unless both parties agree or the agreement permits the change.
3. Eligibility
You must be at least 18 years old and legally able to enter into a binding agreement to schedule or purchase services through the Site.
The Site is not directed to children under 13, and DAPS Services does not knowingly collect personal information from children under 13. A person under 18 may request or authorize paid services only through a parent or legal guardian who accepts responsibility for the request.
4. Account Registration
Certain Site features, including a customer portal, may require you to create or access an account.
Information supplied during registration must be accurate, complete, and current. You are responsible for updating your information when it changes and for keeping passwords, access links, and other account credentials private.
You should notify DAPS Services promptly if you believe that your account or access credentials have been used without authorization. We may temporarily restrict account access when reasonably necessary to investigate suspected misuse, inaccurate account information, or a possible security concern.
5. User Conduct
You agree to use the Site responsibly and only for lawful purposes. You may not:
- Use the Site in a way that violates federal, state, or local law.
- Provide false, incomplete, misleading, or fraudulent information.
- Impersonate another person, customer, business, or organization.
- Attempt to enter restricted portions of the Site or access another user’s account.
- Introduce viruses, malicious code, automated attacks, or other harmful technology.
- Interfere with the Site’s security, performance, availability, or normal operation.
- Use automated tools to scrape, copy, collect, or extract Site content without written permission.
- Send abusive, threatening, deceptive, or unlawful communications through our forms or messaging channels.
- Use the Site in a manner that infringes the rights, privacy, or property of DAPS Services or another party.
We may investigate suspected misuse and cooperate with authorities when required or permitted by law.
6. Intellectual Property
The Site and its contents, including its written material, graphics, photographs, videos, logos, service marks, layouts, software, and design elements, belong to DAPS Services or the parties that have licensed those materials to us.
Applicable copyright, trademark, and other intellectual property laws protect this content.
You may view and use the Site for personal, noncommercial purposes connected with learning about or requesting our services. Without prior written approval, you may not copy, republish, sell, modify, distribute, display, license, or create derivative material from Site content.
No part of these Terms transfers ownership of DAPS Services’ intellectual property to a Site user.
7. Payment and Billing
When you authorize a paid service, you agree to pay the prices, fees, taxes, and other charges disclosed in the applicable estimate, invoice, service agreement, or payment screen.
You must provide accurate billing, contact, and payment information. If payment information is submitted through the Site, it may be handled by DAPS Services or an authorized third-party payment provider in accordance with applicable privacy and security practices. DAPS Services may not directly receive or store complete payment-card details when a third-party processor is used.
A payment dispute does not automatically cancel obligations under an existing service agreement. Customers should contact DAPS Services promptly so billing questions, disputed charges, or suspected payment errors can be reviewed in good faith.
Service pricing, renewal terms, cancellation requirements, and refund eligibility may vary. The written terms attached to the specific service control when they differ from general information displayed on the Site.
8. Privacy Policy
Our Privacy Policy explains what information DAPS Services may collect, why it is collected, how it may be used, and the measures taken to protect it.
Information may include:
- Contact details submitted through forms or customer communications
- Domain and Internet Protocol address information
- Browser and operating-system details
- Pages visited and referral information
- Service requests and customer-support communications
- Information supplied through surveys, contests, or promotional activities
- Mobile numbers and SMS consent records, when a user affirmatively opts in to text communications
We use collected information for purposes such as responding to inquiries, providing customer support, arranging pest control services, maintaining the Site, evaluating performance, improving the customer experience, and communicating permitted updates or offers.
DAPS Services does not sell personal information or provide it to outside parties for direct or indirect mass email marketing. Other disclosures, including disclosures to service providers that support Site or business operations, are described in the Privacy Policy. Mobile information and SMS consent data will not be sold or shared with third parties, including affiliates, for their own marketing purposes.

9. Suspension and Termination
We may restrict, suspend, or terminate access to the Site or an account when we reasonably believe that a user:
- Violated these Terms
- Supplied fraudulent or misleading information
- Attempted to compromise Site security
- Interfered with another user
- Used the Site for unlawful activity
- Created a risk of harm to DAPS Services, its customers, employees, systems, or reputation
Where practical, we may provide notice before taking action. Immediate action may be taken when necessary to protect the Site, our customers, or other parties.
You may stop using the Site at any time. Questions about customer-portal access or account closure may be directed to DAPS Services using the contact information in Section 18. The availability and effect of account closure may depend on portal capabilities, service records, legal obligations, and applicable service agreements.
Account closure does not eliminate outstanding payment obligations or other responsibilities created under a separate service agreement.
10. Disclaimer of Warranties
The Site and its online content are made available on an “as is” and “as available” basis to the fullest extent allowed by law.
We do not promise that every Site feature will operate continuously, remain free of errors, or be protected from every harmful component, security event, or technical interruption. Information displayed on the Site may occasionally contain omissions, outdated material, or typographical errors.
General Site content is not a substitute for an on-site inspection. Pest activity, property conditions, treatment options, preparation requirements, and likely outcomes can differ from one property to another.
This section does not cancel or replace any written service guarantee expressly included in an estimate, service agreement, or other document issued by DAPS Services.
11. Limitation of Liability
To the fullest extent permitted by applicable law, DAPS Services and its owners, affiliates, officers, employees, technicians, contractors, representatives, and agents will not be responsible for indirect, incidental, special, exemplary, punitive, or consequential damages connected with:
- Access to or inability to access the Site
- Reliance on general Site information
- Loss of data, revenue, business opportunity, or goodwill
- Unauthorized access caused by circumstances outside our reasonable control
- Conduct or content supplied by another user or third party
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
Any rights, remedies, guarantees, or limitations connected with an actual pest control service may also be governed by the estimate, invoice, service plan, warranty, or written agreement issued for that work.
12. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless DAPS Services and its owners, affiliates, employees, technicians, contractors, agents, and representatives from claims, losses, damages, liabilities, judgments, and reasonable legal expenses resulting from:
- Your unlawful or improper use of the Site
- Information or content you submit
- Your violation of these Terms
- Your infringement of another party’s rights
- Activity completed through an account under your control
This obligation does not apply to claims caused solely by conduct for which DAPS Services cannot lawfully require indemnification.
13. Governing Law
These Terms are governed by the laws of the State of Georgia, without applying rules that would require the laws of another jurisdiction.
Unless applicable law requires otherwise, legal proceedings arising from these Terms or use of the Site must be brought before a court with lawful jurisdiction over the dispute.
Before filing a legal claim, both parties are encouraged to make a reasonable, good-faith effort to resolve the matter directly.
14. Changes to These Terms
DAPS Services may revise these Terms when business practices, legal requirements, Site features, communication methods, or service processes change.
The revised version will be posted on this page with an updated Effective Date. Changes become effective on the date stated in the revised version.
When required by law or appropriate because of the nature of a change, DAPS Services may provide additional notice or request renewed consent. Changes to these Site Terms will not retroactively alter a signed service agreement unless permitted by that agreement or accepted by both parties.
15. Severability
If a court or other authorized body finds any portion of these Terms invalid, unlawful, or unenforceable, that provision will be limited or removed only to the extent necessary.
The remaining provisions will continue in effect. When legally possible, an invalid provision will be interpreted in a manner that most closely reflects its original purpose.
16. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published on the Site, form the complete agreement concerning your use of the Site.
Pest control services may also be governed by a separate estimate, invoice, proposal, warranty, customer authorization, or service agreement. When a service-specific document conflicts with these general Site Terms, the service-specific document controls for that particular service.
A failure by DAPS Services to enforce one provision does not waive the right to enforce it later.
17. SMS Messaging Terms and Consent
17.1 SMS Consent and Privacy
When you provide a mobile phone number and affirmatively consent to receive text messages, you authorize DAPS Services to send communications to that number as described below.
Mobile information and SMS consent records will not be sold or shared with third parties, including affiliates, for their own advertising or marketing.
Agreeing to receive promotional text messages is optional and is not a condition of purchasing pest control services.
17.2 Types of SMS Communications
Depending on the consent you provide and your relationship with DAPS Services, text messages may include:
- Appointment confirmations and reminders
- Technician arrival or scheduling updates
- Service-related notices
- Estimate or account notifications
- Billing-related communications
- Responses to customer questions
- Follow-up messages after service
- Promotional offers or company announcements, but only when separate promotional SMS consent has been obtained
An example may read:
“DAPS Services reminder: Your pest control appointment is scheduled for [Date] at [Time]. Reply STOP to opt out or HELP for assistance.”
17.3 Message Frequency
Message frequency varies according to your appointments, account activity, service schedule, customer requests, and communication preferences.
You may receive more messages when an appointment is approaching, a service issue requires attention, or you are actively communicating with our team. Promotional message frequency may also vary.
17.4 Message and Data Charges
Standard message and data rates may apply based on your mobile carrier and service plan.
DAPS Services does not determine or collect carrier charges. Contact your mobile provider for questions concerning messaging, roaming, or data fees.
17.5 How to Opt In
You may consent to SMS communications by selecting an unchecked consent option, completing a signed or electronic authorization, or using another documented affirmative method made available by DAPS Services.
Merely entering or submitting a mobile number does not constitute consent to receive promotional text messages.
Consent to promotional text messages is optional and is not a condition of purchasing pest-control services.
Submitting a phone number without providing the required consent does not authorize promotional SMS messages.
17.6 How to Opt Out
You may revoke SMS consent at any time by replying STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE, or by clearly communicating your request through another reasonable method.
DAPS Services will honor valid opt-out requests within a reasonable period, not exceeding ten business days. We may send one final, nonpromotional text confirming the opt-out. No additional messages requiring consent will be sent unless you later provide new consent.
